Definition of Unsolicited Broadcast Email (UBE) Email that the sender can't reasonably expect the recipient to welcome is unsolicited. The best way to be sure is to exchange emails, one to one, establishing permission. If you're running a mailing list, have your list management software reply to a subscription request with a unique, unpredictable piece of information. Only subscribe the address if they send it back. That's called confirmed opt-in. Spammers call it "double opt-in" to make it sound difficult. All modern mailing list management software does it for you automatically, by default.
You can't reasonably expect people to welcome email you send en masse to addreses you aren't sure requested it. That's broadcasting. Email isn't a broadcast medium. Mailing lists only make sense when each subscription request is confirmed by the owner of the address.
Putting people on a mailing list without confirming their permission first is wrong. Sending email to such a list is known as spamming or UBE.

Notice that we didn't say anything about the content of the message. It's still spam even if the addressees are on other mailing lists with similar content. It doesn't matter if it's about mortgage leads or penis pills or current events or your religion. If you sent it in bulk and they didn't ask you for it, you're spamming.
Unsolicited Broadcast Email (UBE) violates that trust and thereby threatens to destroy the public email system.
This Web site is full of spam trap email addresses. They feed, eventually, into our block lists. If you harvest email addresses off this Web site, and send UBE to them, we will report your behavior to your Internet service provider. We will post samples of your spam in sightings. We will include your contact information if we can find it. We may block email from your domain, or from your Internet address range.

Backscatter is spam These days we get a lot of junk email from appliances and software programs that want to do some kind of "challenge/response" ritual, or brag about their prowess in detecting spam and malware. "Challenge/response" challenge messages are spam and we usually ignore them. If your postmaster thinks "challenge/response" behavior is appropriate for your domain, she should, perhaps, be using greylisting instead.Your Barracuda box is wrong. We didn't send you spam or viruses. Some spammer is using our domain again. This "spoofing" is easily proven because the spammers always give a HELO address we never use. We don't want a stream of advertisements from your Barracuda box, especially when every one of them shows the Barracuda box has a faulty design.
If your email filter software thinks it found a malware it should quarantine it or discard it, not bother my users about it. Malware is a Microsoft problem, and we don't use Microsoft products here.
